The Myth of Censorship?!

Whether it is art or obscenity, we must guarantee the challenge of new things and at least open our minds. And then, a competitive culture might appear in Korea. Our country regard ethics and morality with great importance, and we get relative restriction with freedom of expression in art when compared to other countries. Thus it is reasonable that anti-social art is restricted in our country. The standard seems to be fairly restrictive, and the punishment for violating it varies.

Recently, the cartoonist and creator of “The Myth of Heaven”, Lee Hyun-se was found guilty of going against Teenager Protection Act. When a public prosecutor was asked to explain the meaning of guilty, he said that “The Myth of Heaven” is an implant of the wrong sexual morality in the youth of Korea. The public prosecutor insists that investigation of “The Myth of Heaven” be one link of controlling obscenity of mass media. But many people do not think so. Let’s find out why people think that way. The existing law cannot judge obscenity of mass media because it has no definite standard. The existing law simply depends on the judicial precedents. In a precedent obscenity of mass media is defined as something that stimulates, sensual feelings and satisfies sexual desires with lascivious devices. It also hurts the normal sense of sexual shame of the general public and is an idea against sexual morality.
Although “The Myth of Heaven” was published solemnly for adults and for adolescents separately, the prosecutor presented an odd accusation like this: “The Myth of Heaven” is harmful to adolescents even if it was published for adults. According to the prosecutorial announcement, it does not attempt to separate the two groups. The announcement is contrary to the goal of the protection law for juveniles which basically forbids juvenile contact with adults by strictly dividing the law into one for adults and for adolescents. By observing past prosecutions, we can find many wrong points in several places.

How about other countries?
For the last three years, there were only two articles in The New York Times and Washington Post regarding sexual expression problems in literature. In addition, there is not any refutation about lewdness in France which is the cultural center of Europe. Although lewdness has always gotten a sprinkle of arguments and has become a serious discussion topic in Italy, but nobody really thinks it as a big issue. In those countries, America, France and Italy, art and lewdness are approved in their own areas and are completely separated from production and distribution of mainstream publications. And consumers’ judgement is also the main standard of restrictive rationally. Sexual issues are recognized as a liberal field. This way, a novel in a culturally developed country can induce socially wide interest and if this novel becomes a judicial case, it is more shocking than the lewdness itself.

What is the standard of art and obscenity?
We think that the standard of art and obscenity are vague; however the former has artistic sublimation, otherwise the latter does not have it. This is so subjective. Here are some question. Is “Romeo and Juliet” of Shakespeare art or obscenity?, and Is “Don Quixote” of Cervantes art or obscenity? Most people think that they are works of art without question. But these works were disputed to be obscenity during their day. “The Bicycle Thief”, directed by Vittorio De Sica, and “The Heartlessness”, written by Lee Kwang-soo, are some other examples. Of course these works get compliments now. Estimation of works are quite different because artistic sense of value have changed a great deal with the changes of the times. We cannot absolutely estimate work of art. We find it difficult to divide art and obscenity.

“Yellow Hair”, “Lies” have been shown on theaters even though there were some people calling the movies obscene. The films have been mentioned on many mass media not for being artistic but indecent, and it made those movies famous. As a result, many people have watched it and it became the record-breaking hit. Even a saying, “If you want to be successful in advertisement, get involved with indecent controversy.” was bulged out. It is a dangerous conception to commercialize sexuality.

An excessive commercialization would bring about disorder of social value. Therefore, a regulation is required in any form. It is not recommended to have compelling restrain by legal force whatsoever. It is because legal force, fundamentally blocking the possibility of new evaluation, can suppress the freedom of expression. It does not make sense that art is artificially controlled by government, therefore let it be till the time when audience have an active judgement and the art world itself makes regulations voluntarily in order to protect receiving any bad influence in our society derived from commercialization of art.

Then, on the base of this, we can be free from the expression of our desire to satisfy ourselves and pursue the high quality of art. Let’s think about the last word Lee Hyun-se, a famous cartoonist, “If even I have to give up cartooning, novice cartoonist will say, ‘Who will draw, then?’ It will take so much time to cure the conflicts.”
